Atarim AI Fair Use and Acceptable Use Policy

This AI Fair Use and Acceptable Use Policy (“Policy”) governs your use of the AI-powered services, including the AI image and text generation service (“AI Service”), provided by Atarim (“we,” “us,” or “our”). By accessing or using our AI Service, you agree to this Policy.

Content Monitoring and Usage Tracking

While Atarim does not actively monitor the content you generate, we employ automated content filters and usage tracking systems. These tools are designed to flag unusual activity and content that may violate this Policy.

Inappropriate Content

The generation of inappropriate content through our services is strictly prohibited. If it comes to our attention that your use of the AI Service results in the creation or dissemination of any of the following, we reserve the right to terminate your account with immediate effect and without a refund:

  • Pornographic material.
  • False news and disinformation.
  • Content of a politically inflammatory nature.
  • Hate speech, discriminatory, or harassing content.
  • Illegal or harmful content.

Fair Use and System Abuse

The AI Service is subject to a fair use policy to ensure the quality and availability of the service for all users. We reserve the right to determine what constitutes abuse of the system. Should we detect that the service is being abused by you or your users, we will contact you to find a remedy. If a satisfactory solution cannot be reached, we reserve the right to terminate your account and access to our products.

This includes, but is not limited to, enforcing a usage limit, even on plans that are described as having “unlimited” usage. This measure is necessary to comply with the terms of use of our underlying AI providers and to ensure the service is used by humans for legitimate purposes, preventing a disproportionate amount of content generation per month.

Prohibition of Automated Use

When a potential customer clicks on your referral link, a cookie is stored in their browser to track your referral. The cookie is then stored for a generous 30 days to give your referred customers time to decide if they wish to purchase Atarim, or ask us any pre-sale questions they may have.

A referral won’t be awarded if:

  1. The customer uses a different browser to purchase than the one they originally used to visit our site (because the cookie does not exist in that browser)
  2. The customer purchases after 30 days (because the cookie will expire).

Intellectual Property, Content, and Indemnification

User Responsibility and Indemnification: By using Atarim’s AI image and text generation service, you agree to indemnify and hold harmless Atarim against any and all claims, demands, charges, complaints, controversies, and causes of action of any kind (“Claims”) arising from intellectual property infringement claims made against Atarim concerning your generated content. You also agree to hold harmless and indemnify Atarim against all Claims related to your use of the AI service. This indemnification includes reimbursing Atarim for all applicable court costs, litigation expenses (including reasonable legal fees), and any losses or liabilities such as judgements and settlements.

Disclaimer of Warranties: Atarim makes no warranties or representations regarding the content generated by users and is not responsible for any unauthorised use. The accuracy of AI-generated content cannot be guaranteed, and it may not reflect the views of Atarim. You are responsible for ensuring your use of the service is authorised and complies with all applicable laws in your jurisdiction.

Public Domain: By using the AI Service, you acknowledge and agree that any work generated is considered to be in the public domain.

Reporting Unauthorised Use: If you become aware of any unauthorised or illegal use of the AI Service, you are encouraged to report it to us immediately through our official support form.

Governing Law and Jurisdiction

Should any dispute arise under these terms or your use of Atarim’s AI services, the laws of England and Wales shall govern in all respects. You agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute that may arise out of or in connection with this Policy. This applies regardless of the jurisdiction or forum in which you are domiciled, reside, or are located at the time of access or use.

By using the AI Service, you confirm that you are of legal age to enter into a contract in your jurisdiction. Your use of the service signifies your fully informed acknowledgement, understanding, and agreement to this entire Policy. Use of the AI Service without acceptance of these terms constitutes unauthorised use, and you disclaim any and all rights to relief against Atarim, regardless of legal jurisdiction.

Service Discretion and Termination for Abuse

We reserve the right to withdraw or modify the service at any time at our discretion. Any abuse of our systems will result in the immediate deletion of your account without prior discussion, and no refund will be issued.
